Cruz was arrested in '08 for driving under the influence on Route 60 in South Charleston. Failing the sobriety test, he was arrested and taken into custody.
His trouble with the police was only beginning, however. While being fingerprinted, Cruz had an uncontrollable urge and committed a WVC 61 - 2 - 10B: Malicious assult on an officer... or in other words he passed gas -- but not before moving closer to one of the officers, and according to some reports, attempted to fan the fumes.
The complaint read, "The gas was very odorous and created contact of an insulting or provoking nature with Patrolman Parsons." Cruz admitted to having dealth what was smelt, but claimed he was unable to 'hold it no more."
Eventually the assult charge was dropped. He still had to deal with charges for DUI, obstruction and driving without lights. The police station dealt with the additional charge ...with Lysol.
